TERMS AND CONDITIONS
The following terms and conditions document is a legal agreement between Azure Web Design and the Client for the purposes of web site design & development. These Terms and Conditions set forth the provisions under which the Client may use the services offered.
ACCEPTANCE OF WORK –
Quotations are valid for 1 month from date of issue.
Azure Web Design will carry out work only where an invoice has been paid by the Client for the work, unless otherwise agreed by Azure Web Design.
When the Client places an order to purchase a web site or web site updates from Azure Web Design, the order represents an offer to Azure Web Design to purchase the web site or web site updates which is accepted by Azure Web Design only when an invoice is sent to the Client.
No contract for the supply of services exists between Client and Azure Web Design until Azure Web Design sends an invoice to the Client for payment. The invoice equals acceptance by Azure Web Design (or third party supplier) of Clients offer to purchase services from Azure Web Design and this acceptance of work is a valid contract between Client and Azure Web Design regardless of whether Client receives the invoice.
Azure Web Design can withdraw from the contract at any time prior to acceptance.
Additional work requested by the Client which is not specified in the agreed quotation is subject to an additional quotation by Azure Web Design on receipt of specification. If the work is needed as part of an existing project then this may the effect timescale and overall delivery time of the project.
The client agrees to provide all information and content required by Azure Web Design in good time to enable Azure Web Design to complete a design or website as part of an agreed project.
A web site or advertisement can be removed on the written request of the client. Azure Web Design reserves the right to suspend or terminate all or part of the service provided to a client with immediate effect, where [1] the expiry date has passed, or [2] there has been a breach by the client of these terms and conditions or failure to pay outstanding charges.
DOMAIN NAMES
When Azure Web Design is acting as agent for the client, the client will be invoiced for the domain renewal. Should the client fail to pay by the due date, the site and files may be suspended or deleted and Azure Web Design can not be held responsible for the loss.
WEB SITE HOSTING.
It is the client’s responsibility to ensure website hosting fees are paid by the due date. Should the client fail to pay or renew the website hosting fees, the site and files will be deleted and Azure Web Design can not be held responsible for the loss.
PERMISSION AND COPYRIGHT
All pages, images, text and code on Azure Web Design web site at http://www.azurewebdesign.co.uk is copyrighted material.
Client's and any visitors to http://www.azurewebdesign.co.uk may not use any of the pages, images, text or code on the web site for use on client's or visitors own web site or to create a web site, templates without prior written permission from Azure Web Design.
Copyright of the completed web designs, images, pages, code and source files created by Azure Web Design for the project shall be with the Client upon final payment only by prior written agreement. Without agreement, ownership of designs and all code belongs to Azure Web Design.
It is the responsibility of the client to ensure they have the right to use any photograph, digital images or advertising copy which is used in the building of the website. The client agrees to indemnify Azure Web Design against all claims costs arising out of any copyright infringement for such images or text.
These terms of use grant a non-exclusive limited license so that the Client can use the design on one web site on one domain name only. The Client is not permitted to use a design for more than one website without prior written agreement between the Client and Azure Web Design.
The client agrees that Azure Web Design reserves the right to include any work done for the Client in a portfolio of work.
MATERIAL
Azure Web Design reserves the right to refuse to handle:
a) Any media which is unlawful or inappropriate.
b) Any media which contains a virus or hostile program.
c) Any media which constitutes harassment, racism, violence, obscenity, harmful intent or spamming
d) Any media which constitutes a criminal offence, infringes privacy or copyright
Website owners who use e-mail as the primary channel for incoming enquiries do so completely at their own risk. Azure Web Design will take no responsibility for missed enquiries and possible resulting loss in such cases.
LIABILITY
Website owners undertake to check at publication, that the content of their advertisement is correct and complete. Liability for any errors or omissions in the website is the owner’s responsibility and Azure Web Design cannot be held in any way accountable for any consequences caused by such errors or omissions.
The website owner is solely responsible for dealing with persons who access their data and warrant that they will not refer complaints or enquiries about these to Azure Web Design.
In cases where Azure Web Design receives a complaint about a website’s content, the owner agrees to receive and give due attention to the matter, and to discuss and resolve it directly with the complainant. Azure Web Design will not become involved in resolution of such matters in any way other than by sending an acknowledgement to the sender and forwarding the complaint to the advertiser.
TERMINATION
Azure Web Design reserves the right to decline to publish any newly placed data. If any payment has been made, this will be refunded or returned. No compensation will be payable by the Azure Web Design for any loss howsoever incurred if publication of a website is declined.
Azure Web Design reserves the right to withdraw any published advertisement. In such cases, any payment which has been made will be refunded pro-rata based upon the number of days remaining until the previously scheduled expiry date. No other compensation will be payable by the publisher for any loss howsoever incurred if advertisement is withdrawn from publication.
SERVICE LEVEL
Azure Web Design will make every effort to provide clients with a prompt service.
Publication of newly placed websites: Subject to suitable text and image content being provided by clients, & advertisements will usually be published within the agreed time.
Azure Web Design endeavours to maintain continuous availability of the website, but will not be liable if they are not accessible at any time or for any period. Notice will not necessarily be given if the website goes offline or services are temporarily withdrawn.
ADVERTISING
The publisher operates advertising services through the distribution of information on the internet. The advertising service provided consists of:
Publication of information which has been provided by the client On Azure Web Design site
It is assumed that the advertiser understands the general principles of the internet including use of a web browser and e-mail programme.
AZURE WEB DESIGN UNDERTAKING TO ADVERTISERS
The publisher will endeavour to maintain and increase the number of visitors to the website and create measurable response to advertisers in the form of enquiries delivered via their email in advertisements, by telephone if a telephone number is published in an advertisement, and, where a web link is published in an advertisement, by referrals to that website.
The publisher will develop ongoing the website and associated systems to meet the changing requirements of web users, advertisers and technology. The emphasis of this development will be on delivery of detailed information to a sustained and relevant audience.
NOTES ABOUT THESE TERMS AND CONDITIONS
These terms and conditions take precedence over any other terms and conditions. Azure Web Design reserves the right to amend these terms and conditions at any time without notice. Continued use of the service signifies agreement with any changes made to these terms and conditions.
Privacy Policy
Information Collection and Use
Azure Web Design is the sole owner of the information collected on this site. We will not sell, share, or rent this information to 3rd parties.
Financial Information
We do not intend to store or currently store financial details (credit or debit card numbers). All confidential information is used only in accordance with the Data Protection Act. Therefore, we do not store any financial details in any form.
Refunds
Under our terms of business we do not offer refunds on our services
Cookies
A cookie is a piece of data stored on the user’s hard drive containing information about the user. Usage of a cookie is in no way linked to any personally identifiable information while on our site. Once the user closes their browser, the cookie simply terminates. For instance, by setting a cookie on our site, the user would not have to log in a password more than once, thereby saving time while on our site. If a user rejects the cookie, they may still use our site.
Log Files
We use IP addresses to analyse trends, administer the site, track user’s movement, and gather broad demographic information for aggregate use. IP addresses are not linked to personally identifiable information.

This web site may contain links to other sites. Please be aware that Azure Web Design is not responsible for the privacy practices of such other sites. We encourage our users to be aware when they leave our site and to read the privacy statements of each and every web site that collects personally identifiable information. This privacy statement applies solely to information collected by this Web site.
Security
This website takes every precaution to protect our users’ information. All of our users’ information is restricted in our offices. Only employees who need the information to perform a specific job are granted access to personally identifiable information. Correction/Updating Personal Information
If your personally identifiable information changes (such office address, telephone numbers), we will endeavour to provide a way to correct, update or remove the personal data provided to us. This can usually be done by emailing sion@azurewebdesign.co.uk
Notification of Changes
If we decide to change our privacy policy, we will post those changes on our Homepage so our users are always aware of what information we collect, how we use it, and under circumstances, if any, we disclose it. If at any point we decide to use personally identifiable information in a manner different from that stated at the time it was collected, we will notify users by way of an email where posible. Users will have a choice as to whether or not we use their information in this different manner. We will use information in accordance with the privacy policy under which the information was collected.
Cancellation Policy
We will work with our customers to help ensure they are completely happy with the work we produce. In the unlikely event that we are unable to satisfy the customer’s needs, cancellation of the project must be made in writing by the customer. In the event that work is postponed or cancelled at the request of the customer, we reserve the right to retain the original deposit.
In the event that more than the amount of the deposits worth of the anticipated work is completed, additional payment will be due, prorated based on the percentage of work completed. If additional payment is due, this will be billed to the Client within 10 days of notification to stop work.
Return and Refund policy
Because all our work is produced specifically for each customer, returns and refunds are not available. All fees paid are non-refundable.
Hosting
You may cancel any of our hosting packages within 14 days of receiving your web hosting welcome email. To cancel your account, please contact us at sion@azurewebdesign.co.uk
Notification of cancellation must be received within the 14 day period. It is the clients responsibility to secure email confirmation from Azure Web Design that your account has been cancelled. If the client has not yet received email confirmation of account cancellation, then the account remains active, and you will continue to be invoiced. Should you wish to cancel midway through a project this may be done based on mutual agreement, however any outstanding balance for work carried out to that point must be paid in full. Cancellation does not absolve client of any outstanding financial obligations.
Domain Names
Once the domain name has been agreed on via email or on the phone with a sales representative and purchased the amount for the domain name has to be paid to us in full even if cancelled.
This is because we are unable to receive any refunds on bought domain names ourselves. If you wish to still cancel the domain we will set it to cancel and it will not be used by anyone else for the full registered period (usually 1 year).
